Sowohl die konzeptionelle Problematik der Definition von Dienstleistungen und Dienstleistungshandel, als auch die sich aus der Struktur des GATS heraus ergebenden Probleme für eine weiterführende, erfolgreiche Handelsliberalisierung werden untersucht. Darauf aufbauend werden verschiedene Optionen für die Konzeption zukünftiger Liberalisierungsverhandlungen diskutiert. Die zentrale Fragestellung ist hierbei, durch welche Verhandlungsstruktur eine weitere Liberalisierung des internationalen Dienstleistungshandels am besten erreicht werden kann. This paper deals with the problems of international trade in services and analyzes the existing international framework, the General Agreement of Trade in Services (GATS). The distinctiveness of services and services trade and the ensued conceptual differences to goods and trade in goods as well as the structural weaknesses of the GATS that may inhibit progressive services trade liberalization are evaluated. Build on this analysis different approaches are discussed, on how to structure the forthcoming negotiations within the Millennium-Round. The aim of the analysis is to suggest a structure of trade negotiations best suitable to improve the framework for trade in services in a way that will further promote international trade in services. |
